Notice to a Borrower in Foreclosure
If your property goes to foreclosure auction sale and is purchased for more than the total owed to the lender and to all other lien holders, please contact the Public Trustee’s Office after the sale because you may have funds due to you.
General Information
The Adams County Public Trustee is now a part of the Office of the Treasurer, which is, in each county except for Weld, Denver, and Pitkin, a county-wide voter elected official throughout the state. The office is "fee-funded" and receives no taxpayer funding from the Adams County General Fund. Excess fees earned, over what is necessary to operate the Public Trustee's Office, are transferred out of the Treasury to the General Fund each quarter during the year.
The Treasurer and Public Trustee is elected to perform public duties as prescribed in Title 38 of the Colorado Revised Statutes and serves as the neutral intermediate party between the lender and the borrower to assure that each party can exercise its legal rights and remedies. The duties of the Office include processing documents pertaining to Foreclosures of Deeds of Trust (mortgages) and Releases of Deeds of Trust, and, conducting the foreclosure sale. The Treasurer and Public Trustee staff are not allowed to provide legal advice to any party of the foreclosure process, nor to the taxpayers of the county.
Office Closure Policy
If the Treasurer and Public Trustee's Office is closed on a regularly-scheduled Wednesday sale date because of a County-wide office closure (due to weather conditions, etc.) the sales scheduled for that day will be CANCELLED. Any sales cancelled because the office is closed will be CONTINUED to the next regularly-scheduled Wednesday sale date and NEW BIDS WILL BE REQUIRED. If the County is on a "delayed opening schedule" due to unanticipated conditions, the Wednesday sale may be delayed and not begin at 10:00 a.m. If you suspect that our office may be closed due to weather conditions, please attempt to call our office Wednesday morning at 720.523.6250 for further information.
PLEASE NOTE: Any week there is a Federal Holiday, there will be NO Public Trustee Sale/Auction held.

PLEASE NOTE: The foreclosure laws may CHANGE because of legislation adopted each year by the Colorado Legislature. Foreclosure cases may be processed (and have different legal rights and remedies) depending on when the foreclosure was filed or started. PLEASE REFER to the Colorado Revised Statutes, Title 38, Article 38 for changes and their effective dates to assure compliance with the law at the time the foreclosure is filed or started.
